When a Daee Makes a Mistake in Minhaj

Question: Noble Sheikh, a Daee (Caller) makes a mistake in an affair from the affairs of minhaj (methodology) or aqeedah (creed) and this mistake has been spread either by writings that he wrote or by a tape that has been spread amongst the people; so what is the method for advising someone who has fallen into a mistake like this? And what if the one who errors remains upon his error and refuses to take the advice of the advisers, so then is it permissible for the one who knows the error from what is correct and the truth from the falsehood to make clear the condition of this man to the people and to make clear his mistakes and warn them from him or is this in opposition to the methodology of the Salaf, may Allah have mercy upon them? Provide us with a ruling, may Allah reward you.

Answer:

Sheikh Ahmad An-Najmee:

All praises belong to Allah may the peace and blessing be upon the Messenger of Allah, and upon his family and his companions; as to what follows.

Firstly: You advise him to fear Allah the Mighty and Majestic, and you advise him a secret advice. Then you repeat the advice a second time, and a third time. So if he refuses to accept the advice and he persist upon what he is upon then after this he should be treated with the treatment of an innovator, if he acknowledges that this is a minhaj error. But if he denies this, and swears he did not know this and that he does not have this (incorrect) belief in this situation you turn away from him and leave him and his affair is with Allah.

Yes, if he refuses to take advice and that which he is accused of is apparent upon him and clear, then in this situation his affair is made clear to the students of knowledge so they will know his condition. Rather in some situations clarifying the condition of individuals like this becomes an obligation specifically upon the person who knows his condition. And some of the narrations transmitted from the Salaf make clear the obligation to be stern with the person who is like that. And with Allah lies all success.

Rinsing out the mouth and nose while fasting

Question:

• If the fasting person rinses his mouth or nose out, and some water reaches his stomach, does this break his fast?

Answer:

• If the fasting person rinses out his mouth or nose, and some water enters into his stomach then it does not break his fast. This is because he did not mean for it to happen. Allah said in the Quran {There is no sin upon you for what you have done in error, but rather that which your heart has intended} (33:5).

Swallowing mucus and phlegm and your fast

Question:

• What is the ruling about swallowing mucus and phlegm for the fasting person?

Answer:

• Mucus and phlegm that does not reach the mouth, then it does not break your fast. If it reaches the mouth, then it was swallowed there is a difference of opinion among the scholars.

• From them are those that say it breaks the fast. They say that this is because it is like food and water. From them also, are those that say that it does not break ones fast. They say it is because it is like saliva. It is known about saliva that it does not break you fast even if it is compiled and swallowed, it has no effect on the persons fast.

• When the scholars disagree, the place to return to is the Quran and the Sunnah. If we are in doubt about the situation of whether or not it breaks the fast. The basic principle is that the fast is not broken and we build off of that, so we understand from this that these things do not break someones fast.

• The important thing is that the individual tries to get rid of his mucus and phlegm and does not to bring it to his mouth from the back of his throat. If it comes to his mouth then he should spit it out whether or not he is fasting. As far breaking the fast, then a strong proof is need so that it may be used a defense in front of Allah for the breaking of the fast.
